LI Riders - Terms and Conditions of Service

Welcome to LI Riders. These Terms and Conditions ("Terms") govern your access to and use of the LI Riders mobile application, website, and related services (collectively, the "Service"). By creating an account, booking a trip, or using our Service, you agree to be bound by these Terms and our Privacy Policy.
1. Definitions
- "LI Riders," "we," "us," "our" refers to the company providing the ride-hailing platform.
- "User," "you," "your" refers to any person who accesses or uses the Service.
- "Rider" refers to a User who requests, receives, or pays for transportation or delivery services.
- "Driver" refers to the independent third-party provider of transportation or delivery services who uses the platform to connect with Riders.
- "Trip" refers to any service booked through the app, including but not limited to: standard rides, shared rides, luxury rides, executive car services, and parcel/courier deliveries.
2. The Service
LI Riders is a technology platform that connects Riders with independent Drivers. WE ARE NOT A TRANSPORTATION CARRIER. Drivers are solely responsible for the transportation services they provide. We do not own, employ, or endorse any Drivers.
You acknowledge that the provision of services by Drivers is subject to their availability, and LI Riders does not guarantee the availability of the Service at any specific time or location.
3. User Accounts
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Service. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it promptly if it changes.
4. Booking and Payment
Fares: Fares for transportation are calculated based on a base rate, distance, time, and dynamic pricing factors (e.g., high demand). The estimated fare will be shown before you confirm your booking. The final fare may differ based on the actual route taken, traffic, and waiting time.
Payments: You authorize LI Riders to charge your designated payment method for the full fare, including applicable taxes, tolls, surcharges, and fees. All payments are final and non-refundable, except as expressly stated in our Cancellation Policy.
Receipts: A digital receipt will be provided via email and in the app upon completion of a Trip.
5. Cancellation Policy
Riders may cancel a booked Trip through the app. However, a cancellation fee may be charged if the cancellation occurs after a Driver has been assigned and is en route, or if the Rider is not present at the pickup location within a reasonable waiting time (e.g., 2-5 minutes) after the Driver's arrival.
Drivers may cancel a booking, but repeated cancellations may impact their status on the platform.
6. User Conduct and Responsibilities
Rider Conduct: You agree to behave in a lawful, respectful, and non-disruptive manner. You are responsible for your conduct and the conduct of any minors or other individuals you accompany. Abusive, violent, or discriminatory behavior towards Drivers or other passengers will result in immediate account termination.
Safety: You must wear a seatbelt at all times during the Trip. You are prohibited from carrying weapons, illegal substances, or any hazardous materials in the vehicle.
Vehicle Damage: You are financially responsible for any damage you, or your party, cause to the Driver's vehicle (including soiling, spills, or vomiting) beyond normal wear and tear. A cleaning or repair fee will be charged to your account.
Lost Property: LI Riders and Drivers are not responsible for any personal property left in a vehicle. We will make reasonable efforts to assist in connecting Riders with Drivers to recover lost items.
7. Types of Trips & Specific Conditions
Shared Rides (LI Riders Pool): By choosing a shared ride, you agree to potential additional stops to pick up or drop off other passengers. The route and travel time may be longer than a standard ride. No smoking or consumption of alcohol is permitted in shared rides.
Luxury/Executive Rides: Higher standards of vehicle and driver professionalism apply. A higher cancellation fee may be in effect due to the specialized nature of the service.
Parcel/Delivery Services: You are solely responsible for accurately describing the item, its value, and ensuring it is legal to transport. Prohibited items include cash, firearms, illegal goods, perishables requiring refrigeration, and live animals (except service animals). LI Riders is not liable for loss or damage to parcels beyond the coverage provided by the Driver's insurance.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LI RIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT OF FEES YOU PAID TO LI RIDERS IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
We are not liable for the acts, errors, omissions, or conduct of any Driver, including but not limited to property damage, personal injury, or death.
9. Indemnification
You agree to indemnify and hold harmless LI Riders, its affiliates, and their respective officers, directors, and employees from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from: (a) your breach of these Terms; (b) your use of the Service; or (c) your violation of any law or the rights of a third party.
10. Intellectual Property
The LI Riders Service, including all associated software, logos, trademarks, and content, is the exclusive property of LI Riders and is protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for personal, non-commercial use.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
12. Governing Law and Disputes
These Terms shall be governed by the laws of [Your State/Country]. Any dispute arising from these Terms or your use of the Service shall be resolved through final and binding arbitration, rather than in court.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via the app or by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
